Price and Scott Discussed the Supreme Court decision on the requirement for public adjusters being licensed.
The Texas Supreme Court’s decision regarding the requirement for public adjusters to be licensed is an important ruling with significant implications.
In a recent decision, the Texas Supreme Court upheld the requirement that public adjusters must be licensed to represent individuals and companies in property damage claims. The case involved Stonewater Roofing, a contractor that argued the licensing requirement violated their First Amendment right to free speech and Fourteenth Amendment right to due process. Stonewater claimed the statute was overly restrictive and vague, infringing on their ability to communicate with clients and insurance companies.
The Court, however, found that the statute regulates conduct rather than speech. It determined that the law’s intent is to protect consumers from potential conflicts of interest and ensure that those representing insured parties are qualified and regulated. The decision emphasized that the licensing requirement does not unconstitutionally restrict free speech or due process rights and provides sufficient clarity regarding prohibited conduct.
This ruling reinforces the regulatory framework established by the Texas Legislature to safeguard consumers and maintain the integrity of the insurance claims process following catastrophic events (JD Supra) (Claims Journal).
